PRIOR CITY COUNCIL ACTION:

City Council ins 2019 created City of Cibolo Reinvestment Zone #1 for the subject property that Aisin was constructed on. 

BACKGROUND:

Chapter 312 of the Texas Tax Code, also known as the Property Redevelopment and Tax Abatement Act, authorizes cities, counties, and special districts to offer temporary tax abatements to encourage economic development. A tax abatement is a local agreement that exempts all or part of the increase in the value of new real property or tangible personal property from taxation for a specific period

City staff worked with the City Secretary to publish public notice for this hearing in accordance with the Texas Property Redevelopment and Tax Abatement Act, Texas Tax Code Chapter 312  which requires a minimum of a seven (7) day public notice. The newspaper of record for the City of Cibolo is the Seguin Gazette. The notice was published October 15 & 19, 2025

Staff mailed the attach notice to Superintendents of Marion ISD, & Schertz-Cibolo-Universal City ISD, Guadalupe Tax Assessor- Collector, Chief Appraiser for
Guadalupe Appraisal District. Staff hand delivered letters to Guadalupe County Judge Kyle Kutschner and Guadalpe County Commissioner Pct. 4 Stephen German on October 14, 2025. 

The establishment of this reinvestment zone by ordinance is the next step in the process for Project Theo's recruitment and will allow the City to enter into a chapter 312 agreement should Project Theo pursue purchasing and developing  the subject property.  Earlier in this meeting a public hearing was held related to the establishment of "City of Cibolo Reinvestment Zone #2" and also an agenda item related to authorizing the City Manager to submit a final incentive offer to Project Theo's representation.

Staff recommends approval of this ordinance.
